TERMS OF SERVICE
OVERVIEW
This website is operated by JARDE, a trading name of Julia Interior Architecture and Design Ltd, a company registered in England and Wales under company number 15091072.
Throughout these Terms, the words “JARDE”, “we”, “us” and “our” refer to Julia Interior Architecture and Design Ltd.
These Terms of Service, together with our Privacy Policy, Delivery & Shipping Policy and Returns & Refunds Policy, govern your access to and use of our website, products and services.
By accessing our website, creating an account or placing an order, you agree to be bound by these Terms. If you do not agree to them, you should not use our website or place an order.
Nothing in these Terms excludes or limits any rights that cannot legally be excluded or limited.
1. ELIGIBILITY AND CUSTOMER INFORMATION
You must be legally capable of entering into a binding contract to place an order.
You agree to provide accurate, complete and current information, including your name, email address, telephone number, billing information and delivery address.
You are responsible for checking that all information supplied during checkout is correct. We are not responsible for delays, losses or additional costs resulting from incorrect or incomplete information provided by you.
You are responsible for keeping your customer account secure and for all activity carried out through it.
2. CONSUMER AND BUSINESS CUSTOMERS
We sell to both:
- individual consumers purchasing for personal use; and
- business customers, including interior architects, interior designers, architects, developers, hospitality businesses and trade professionals.
Certain statutory consumer rights apply only where you purchase wholly or mainly for purposes outside your trade, business, craft or profession.
Business customers do not have an automatic consumer cooling-off right unless we expressly agree otherwise in writing.
3. PRODUCT INFORMATION
We take reasonable care to describe and display our products accurately. Product specifications, dimensions, compositions, finishes, images and availability may be updated from time to time.
Images are provided for illustrative purposes. Colours and product appearance may vary depending on:
- screen and device settings;
- lighting conditions;
- the selected print material;
- surface texture;
- production processes; and
- natural material characteristics.
The scale, crop and placement of a mural design may vary depending on the dimensions and proportions of the wall.
Where exact colour, texture, scale or finish is important, we strongly recommend ordering a sample before placing a full wallpaper or mural order.
4. SAMPLES
JARDE sample sets are printed or prepared specifically for each order in the selected design and material.
Samples are provided to help customers assess colour, scale, print quality, texture, finish and material suitability before purchasing a full wallpaper or mural order.
Because samples are prepared specifically to order, they are non-returnable and non-refundable, except where they arrive damaged, faulty or different from the sample ordered.
Samples are intended as a guide. Minor differences may occur between a sample and the finished product because of material batches, printing conditions, texture and natural variation.
Natural Wallcovering and Wood Veneer samples are not part of the standard sample-set service. Their availability and pricing vary by product and must be discussed with us separately.
5. WALLPAPERS AND MURALS
JARDE wallpapers and murals are printed and prepared specifically according to the design, material, colourway and dimensions selected or approved for the order.
These products are made to order and may be personalised to the customer’s requirements. They cannot be returned, exchanged or refunded because of:
- a change of mind;
- incorrect measurements supplied by the customer;
- selection of an unsuitable size, material, design or colourway;
- dissatisfaction with colour or texture where the product corresponds with the order and is not faulty; or
- a change in the customer’s project or circumstances.
This does not affect your legal rights where a product is faulty, damaged, incorrect or materially different from the product ordered or approved.
6. NATURAL WALLCOVERINGS AND WOOD VENEER
Natural Wallcoverings and Wood Veneer products may be sold as full rolls or in the format described on the relevant product page.
Natural materials may contain variations in:
- colour and shade;
- fibre and weave;
- grain and pattern;
- texture and surface;
- thickness and finish; and
- the distribution of naturally occurring characteristics.
These variations are inherent features of natural materials and are not defects.
Return eligibility for standard, unopened Natural Wallcovering or Wood Veneer rolls is governed by our Returns & Refunds Policy. Opened, cut, used, altered or damaged rolls cannot be returned unless the product is faulty.
We recommend requesting a material sample before ordering where colour, grain, texture or natural variation is an important consideration. Sample availability and pricing vary by material.
7. MEASUREMENTS AND ORDER QUANTITIES
Customers are responsible for providing complete and accurate measurements and ordering a sufficient quantity of product.
You should take account of:
- trimming allowances;
- wall irregularities;
- pattern placement;
- installation requirements;
- doors, windows and architectural features; and
- reasonable contingency material.
Any measurement guidance we provide is based solely on the information supplied by the customer and does not replace a professional site survey.
JARDE is not responsible for products ordered using incorrect, incomplete or inaccurate measurements supplied by the customer.
Any replacement or additional material required because of incorrect measurements or insufficient quantities will be treated as a new order and charged accordingly.
8. ARTWORK, CROPPING AND CUSTOMER APPROVAL
Where we provide a digital preview, crop, artwork proof, panel layout or bespoke design proposal, you are responsible for checking:
- dimensions;
- proportions;
- design placement;
- cropping;
- colourway;
- panel sequence;
- spelling or personalised information; and
- any other details shown.
Production may begin once approval has been received.
Once artwork has been approved and production has begun, the order cannot normally be amended, cancelled, returned or refunded because of an error or preference that was visible in the approved artwork.
Digital previews are intended to demonstrate general design placement. They are not architectural surveys or guarantees of the final appearance in a particular room.
9. ORDERS AND CONTRACT FORMATION
Placing an order constitutes an offer to purchase.
We reserve the right to decline or cancel an order where, for example:
- payment cannot be authorised;
- the product is unavailable;
- an obvious pricing or description error has occurred;
- the order appears fraudulent or unlawful;
- delivery cannot reasonably be arranged to the address supplied; or
- the order breaches these Terms.
You will receive an automated acknowledgement or confirmation after placing an order. We may contact you where further measurements, artwork approval, product information or delivery details are required.
We will refund any payment received for an order that we are unable to accept.
10. CANCELLATIONS AND AMENDMENTS
Please contact us immediately at contact@jarde.co.uk if you wish to request an amendment or cancellation.
Submitting a request does not guarantee that an order can be amended or cancelled.
Wallpapers, murals and sample sets cannot normally be amended or cancelled once printing, preparation, cutting or bespoke design work has begun.
Natural Wallcovering and Wood Veneer orders cannot normally be amended or cancelled once the order has been processed or prepared for dispatch.
Any cancellation or return rights that apply by law remain unaffected.
11. PRICES, CURRENCIES AND PAYMENT
Prices are displayed in the currency applicable to the customer’s selected market or location.
Where local currencies are displayed, prices may be converted from our store currency using exchange rates and rounding rules applied by Shopify or the payment provider.
The final price payable will be shown at checkout before the order is submitted.
We reserve the right to change prices at any time. A price change will not affect an order that we have already accepted, except where there is an obvious and genuine pricing error.
Payment must be authorised before an order is processed. Available payment methods are displayed at checkout.
Any bank, card-provider or currency-conversion charges imposed independently by your payment provider are your responsibility.
12. DELIVERY AND SHIPPING
Production, preparation and delivery estimates are provided in our Delivery & Shipping Policy and, where applicable, at checkout.
Delivery dates are estimates and may be affected by:
- courier operations;
- customs procedures;
- adverse weather;
- public holidays;
- remote-area delivery;
- incorrect customer information; and
- events outside our reasonable control.
We will provide tracking details where tracking is available.
For consumer orders, responsibility for the goods remains with us until the goods are delivered into your physical possession or to a person identified by you to receive them.
For business customers, risk may pass when the goods are delivered to the carrier, where permitted by law and agreed as part of the order.
You must notify us promptly if an order has not arrived within the estimated delivery period.
13. CUSTOMS, DUTIES AND IMPORT CHARGES
International orders may be subject to customs duties, import VAT, taxes, clearance fees or other charges imposed by the destination country or courier.
Where checkout, an order confirmation or our Delivery & Shipping Policy expressly states that such charges are included, they will be handled in accordance with the delivery terms offered for that order.
Unless expressly stated otherwise, customs duties, import taxes and local clearance charges are not included in the product or delivery price and may be payable by the customer.
Customers are responsible for providing any information or documentation reasonably required by the courier or customs authorities.
An order refused, left unclaimed or returned because the customer has not provided required information or paid charges for which the customer is responsible will be dealt with under our Delivery & Shipping and Returns & Refunds Policies.
14. CHECKING YOUR ORDER
You must inspect the order as soon as reasonably possible after delivery and before:
- cutting the product;
- applying adhesive;
- installing or hanging it;
- altering the product; or
- disposing of the packaging and labels.
Check the design, material, measurements, quantity and panel sequence against your order confirmation and approved artwork.
For murals, all panels should be laid out and checked together before installation begins.
Visible damage, defects, shortages or discrepancies should be reported to us in writing within 48 hours of delivery, together with clear photographs.
This 48-hour reporting request does not affect statutory rights relating to faults that could not reasonably have been identified during the initial inspection.
15. DAMAGED, FAULTY, MISSING OR INCORRECT PRODUCTS
If an order arrives damaged, faulty, incomplete or incorrect, contact us at contact@jarde.co.uk and provide:
- your order number;
- photographs of the complete product;
- close-up photographs showing the issue;
- photographs of all relevant mural panels;
- photographs of the packaging; and
- a photograph of the shipping label.
Do not cut, install, paste, alter, discard or return the product until we have reviewed the issue and provided instructions.
Where a product is confirmed to be faulty, damaged or incorrect, we will provide an appropriate remedy in accordance with applicable law. Depending on the circumstances, this may include repair, replacement, reprint, price reduction or refund.
16. INSTALLATION
Products must be inspected before installation.
Customers and installers are responsible for:
- ensuring that the wall or surface is suitable;
- preparing the surface correctly;
- using an appropriate adhesive and installation method;
- checking panel sequence and alignment;
- protecting the product during handling; and
- carrying out installation with reasonable skill and care.
We recommend using an experienced professional wallcovering installer.
If you require general guidance regarding installation, please contact us at contact@jarde.co.uk before installation begins.
JARDE is not responsible for damage caused by unsuitable surfaces, incorrect preparation, inappropriate adhesive, installation errors, poor workmanship or failure to inspect the product before installation.
Nothing in this section excludes liability that cannot lawfully be excluded.
17. RETURNS AND REFUNDS
Returns, cancellations, exchanges and refunds are governed by our Returns & Refunds Policy, which forms part of these Terms.
In summary:
- made-to-order wallpapers and murals are not returnable because of a change of mind;
- sample sets are non-returnable and non-refundable;
- eligible standard Natural Wallcovering or Wood Veneer rolls may only be returned under the strict conditions set out in our Returns & Refunds Policy; and
- legal rights relating to faulty, damaged, incorrect or misdescribed products remain unaffected.
Where a refund is due, it will be issued to the original payment method in accordance with applicable law.
18. INTELLECTUAL PROPERTY
All website content, including JARDE names, logos, artwork, mural designs, patterns, photographs, graphics, text, product descriptions, videos and page layouts, is owned by or licensed to JARDE and is protected by intellectual property laws.
You may not, without our prior written permission:
- reproduce or copy our designs;
- digitally extract or recreate our artwork;
- manufacture products using our designs;
- distribute, publish, sell or commercially exploit our content;
- remove copyright or branding information; or
- use our images, patterns or designs to train, develop or operate artificial-intelligence or image-generation systems.
Purchasing a JARDE product does not transfer ownership of the underlying design or intellectual property.
Trade customers may use product imagery solely for promoting a genuine JARDE specification or project, subject to prior permission and appropriate credit.
19. REVIEWS, PHOTOGRAPHS AND FEEDBACK
Where you voluntarily submit a review, testimonial, photograph or other content, you confirm that you have the right to provide it.
Unless otherwise agreed, you grant us a non-exclusive, worldwide, royalty-free licence to reproduce and display that content for operating and promoting JARDE.
We will not knowingly publish personal information beyond what you have agreed to share.
We may remove content that is unlawful, misleading, infringing, abusive or otherwise inappropriate.
20. THIRD-PARTY SERVICES AND LINKS
Our website may use or link to services operated by third parties, including Shopify, payment providers, delivery providers and product-customisation applications.
Your use of a third-party service may also be subject to that provider’s terms and privacy policy.
We are not responsible for the content or independent operation of third-party websites, except where liability cannot lawfully be excluded.
JARDE is powered by Shopify, but all purchases made through our store are contracts directly between the customer and JARDE.
21. ACCEPTABLE USE
You must not use our website:
- for unlawful or fraudulent purposes;
- to infringe intellectual property or privacy rights;
- to transmit malware or harmful code;
- to interfere with website security or operation;
- to collect information about other users without permission;
- to submit false or misleading information; or
- to scrape, copy or systematically extract our website content without permission.
We may suspend or restrict access where we reasonably believe that these Terms have been breached.
22. LIABILITY
We do not exclude or limit liability where it would be unlawful to do so, including liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- breach of statutory consumer rights.
We are not responsible for losses caused by:
- incorrect information or measurements supplied by the customer;
- misuse or unsuitable installation of a product;
- events outside our reasonable control; or
- business losses suffered by a consumer customer that were not reasonably foreseeable when the contract was made.
For business customers, to the fullest extent permitted by law, we will not be liable for indirect or consequential losses, loss of profit, loss of business, loss of opportunity or loss of goodwill.
Nothing in these Terms affects rights that cannot legally be excluded or restricted.
23. EVENTS OUTSIDE OUR CONTROL
We are not responsible for a failure or delay caused by events outside our reasonable control, including severe weather, transport disruption, customs delays, industrial action, supply interruption, war, civil disturbance, natural disaster, epidemic, government action or failure of communications or technology systems.
Where such an event affects an accepted order, we will take reasonable steps to contact you and minimise disruption.
24. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes in our business, website, products, services or legal obligations.
The current version will be published on this page together with its effective date.
Changes will not retrospectively reduce rights relating to an order already accepted, except where required by law.
25. GOVERNING LAW
If you are a consumer, these Terms and any contract between you and JARDE are governed by the laws of England and Wales, without depriving you of any mandatory consumer protections that apply in the country where you live.
Consumers may bring proceedings in the courts available to them under applicable consumer law.
If you are a business customer, these Terms and any dispute or claim arising from them are governed by the laws of England and Wales, and the courts of England and Wales will have exclusive jurisdiction.
26. GENERAL PROVISIONS
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect.
A delay or failure by us to enforce a right does not waive that right.
You may not transfer your rights or obligations under these Terms without our written consent.
We may transfer our rights or obligations as part of a sale, restructuring or transfer of our business, provided that this does not reduce any mandatory rights you have.
These Terms, together with the policies referenced in them and the information confirmed in your order, form the agreement between you and JARDE.
